Three people were killed in a Fluvanna County, Virginia accident last week when a truck driver lost control of his vehicle. Sources say the January 23, 2017 accident occurred when a southbound tractor trailer carrying sand crossed the center line while heading down hill on a curve on Route 15. The truck struck a northbound car before falling over on its side.

Tragically, all three people in the car were pronounced dead at the scene of the accident. A married couple, both 69, and the mother of the woman, 91 were killed. The truck driver suffered minor injuries and was charged with reckless driving. Additional charges are pending. All people involved in this incident were wearing seat belts at the time of the crash.

We send our condolences to the family of the victims. Unfortunately, when trucks and cars collide, the folks in the smaller vehicle often end up with serious injuries – or are killed. The sheer difference in size between the truck and car frequently spell disaster.

Professional truck drivers should know to slow down on curves and when going downhill. We’ll be curious to learn about the driver’s state of mind at the time of the accident. Was he driving drowsy? Or perhaps he fell asleep at the wheel? The investigation should reveal more about why the driver lost control of his vehicle.

Professional drivers often work long hours without a break to sleep, eat or rest. Though the job isn’t physically demanding in the traditional sense, long drives can take a real toll on the body. It’s possible this tractor trailer driver hadn’t gotten enough rest before his shift, or that he was burnt out by long hours on the road. Highway hypnosis can occur in professional truck drivers who have been at the wheel too long.

Until we know more, it is impossible to speculate. Still, the family of the victims undoubtedly have questions about their rights following the crash. We encourage them to reach out for a free, no-risk consultation from our firm.

Most of us will driver climb behind the wheel of a big rig truck, but this new list of the most common traffic violations made by professional truck drivers can give us all insight into their world. The list was released this month, as part of the annual Operation Safe Driver Week. The top five violations were:

1. State, local moving violations. These kinds of violations are specific to the locations where the driver got ticketed. For example, driving in a carpool lane illegally – the definition of carpool lane can vary even within the same state. Some carpool lanes require two people per vehicle, while others require three or more. For long-distance professional drivers, it can be difficult to keep up with the changing rules of the road.

2. Speeding. Speeding tickets accounted for 20% of all traffic infractions. With pressure on drivers to reach their destination by a certain time, truck drivers often find themselves traveling faster than is legal.

3. Failure to obey traffic control device. This one is much less confusing than it sounds. A traffic control device, nine times out of ten, simply refers to a sign. So if a truck driver blows a red light or rolls through a stop sign, they are ticketed for failing to obey a traffic control device.

4. Failing to use a seat belt. Just like non-professional drivers, truckers are required to wear a seat belt when their vehicles are in motion.

5. Using a handheld phone. Truck drivers are required to use bluetooth, hands-free headsets should they need to make phone calls on the road. Unfortunately, this doesn’t always happen – as evidenced by the large volume of tickets written for using handheld phones at the wheel.

Rush hour accidents are all too common. When folks are running late or sleepy at the wheel, they’re more prone to making mistakes on the road. An accident earlier this week goes to show exactly what can happen when drivers rush to pass tractor trailers.

A Tuesday morning crash on I-264 in Newport News sent one woman to the hospital, news outlets reported. Police say the incident happened just after 6:00 in the morning on December 13, 2016.

What happened? Police are still investigating the crash, but one thing is clear: the driver of a Kia attempted to pass a tractor trailer using the right lane and the shoulder of the road. The vehicles collided, which caused the driver of the Kia to lose control of their car. The Kia ran off road and into the center median.

Meanwhile, the driver of the tractor trailer over-corrected, sending his truck on its side. Emergency services needed several hours to clean up the scene of the accident.

The driver of the Kia was hospitalized because of the injuries she sustained in the wreck. Charges for improper passing of another vehicle are pending. Both drivers involved in the wreck were wearing seat belts.

Not surprisingly, traffic in the area backed up for hours. This is a very congested area of Hampton Roads, particularly during rush hour.

This incident showcases the instability of large trucks. Because of their heavy weight and over-sized presence on the road,  they have a high center of gravity. Even the slightest bump can send a tractor trailer rolling over to its side. In fact, most truck rollovers don’t occur because of a collision – they happen because drivers fail to slow down enough on curving roads.

Be sure to give tractor trailers a wide berth on the road – you never know what might trigger a rollover.

A multi-vehicle crash in Newport News has landed two people in the hospital. The incident occurred on December 2nd, 2016 on I-664. Police say the driver of an 18-wheeler milk truck lost control of the vehicle and collided with three other cars. The truck was leaving I-664 and was exiting the ramp to turn right onto Chestnut Avenue. Milk was reportedly spilled across the road. The exit ramp was closed while workers cleaned up.

Two people were injured in the accident. The driver of the milk truck was charged with reckless driving and driving without a commercial license. The accident is still being investigated by police, but the reckless driving charge is a sign that this truck driver made a negligent choice – or several choices – behind the wheel. Of course, without a commercial license, there is a chance this driver had little experience behind the wheel of large truck. There is no telling what their background with commercial driving truly is. The investigation will likely reveal this information.

We send our best wishes for quick and complete recoveries for the folks injured in the crash. Undoubtedly, they will need time to recover – perhaps they will need to take time off of work to do so. That time off doesn’t come cheap for most workers, many of whom simply won’t be paid for the days they miss.  No one injured by the negligence of another person should have to shoulder the burden of such things.

We recommend that the victims in this accident reach out to our team. An experienced attorney can help them navigate the confusing and often overwhelming legal process following a crash like this one. We can help victims pursue compensation for medical bills, lost wages and pain and suffering.

Highways are the site of many a deadly accident, and understandably so: the high speeds and high volume of traffic are a perfect storm of factors that all too frequently lead to fatal accidents. This week in Tazewell County, Virginia, an accident involving an SUV and a tractor trailer show just how quickly such incidents can occur. The accident, on Route 460 and Route 820, claimed the life of one man.

Authorities say the accident happened when the driver of a logging truck made a U-turn on Route 460 the afternoon of October 17, 2016. Upon completing the turn, it pulled in front of a Jeep Cherokee. The driver of the Cherokee rear ended the truck and was killed in the collision. The truck driver was not injured in the accident.

Police have charged the driver of the logging truck with failing to yield to the right of way. As the investigation continues, the truck driver may face additional charges.

Left hand turns are inherently dangerous, but they’re even more so for large, slow vehicles like logging trucks. Make a U-turn like this on a highway is a big risk for tractor trailers – one has to wonder if there was a safer way for the driver to make this move. Undoubtedly, taking this dangerous turn in front of oncoming traffic was not the way to go.

We send our condolences to the victim’s family and loved ones. Such a senseless accident has undoubtedly left them with questions about the incident and how to move forward. An experienced car accident attorney can help answer many of those questions – and fight for the justice they deserve. We encourage them – and anyone involved in an accident like this – to reach out to our team as soon as possible.

A truck accident in western Nebraska has claimed the lives of a young family. ABC News reports that a mother, father and children aged 3, 1 and 2 months were killed in a July 31st crash. The family was making its way from Minnesota to a missionary training program in Colorado. They’d hoped to move to Japan for the next several years to work as missionaries.

Authorities say the crash occurred in a construction zone along westbound interstate 80. The regular speed limit of 75 miles per hour had been reduced to 65 mph, but a semitrailer truck failed to slow down. The truck slammed into the back of the family’s minivan, a collision that killed all five family members. The forward momentum of the van pushed the vehicle into several other cars. The driver of the van immediately in front of the family was also killed in the accident.

The truck driver was allegedly distracted and inattentive at the time of the crash. He had been charged with multiple counts of vehicular homicide as well as reckless driving.

This crash is said to be one of the worst in the last decade for Nebraska, second only to a 2006 collision between a bus and a train, an accident that claimed the lives of 11 people.

These kinds of accidents are senseless and preventable. No driver – particularly not a professional truck driver – should be so inattentive behind the wheel.

Two construction workers were killed Tuesday in an accident on U.S. 11. The incident occurred when the driver of a dump truck working on site backed over two colleagues. The female worker was killed instantly, while the man worker responded to questions before ultimately succumbing to his injuries. Both victims were dragged in the accident, authorities say. No charges have been filed against the driver of the dump truck.

We send our condolences to the families and friends of the victims. Construction sites are dangerous places, but accidents like this one shouldn’t be the reason why. The men and women responsible for maintaining the roads around us put their lives on the line when working along busy highways like U.S. 11. They should be able to rely on the knowledge that their colleagues have the crew’s safety in mind when working.

Dump trucks and other large construction vehicles typically have loud warning whistles to alert pedestrians of their movement. Investigators are still looking into whether this truck actually sounded as it was reversing. The results of the investigation could lead to charges for the driver of the dump truck.

It is also possible that the dump truck driver received the all clear from a another worker who had signaled to him that it was okay to back up. If that’s the case, the families of these victims may have grounds for filing wrongful death claims. Employers need to be held responsible for any kind of breakdown of the safety procedures that occur on their job sites.

Nobody should be risking their lives at work. Whether this is a tragic accident or symptom of a larger safety issue within the company, workers deserve a safe place to earn a living.

A new study has found truck drivers with untreated sleep apnea are five times more likely to be involved in a crash than those following a mandated treatment program. Researchers followed 1,000 truck drivers for a year. 70 of the drivers who received treatment were in accidents, while just 14 of drivers who were being treated or did not have sleep apnea had wrecks. These findings add to the overall medical opinion that sleep apnea is one of the most common causes of daytime drowsiness.

Many truck drivers are at risk of losing their job once diagnosed. In fact, truck drivers with untreated sleep apnea are employed at a company just one-third as long as those without such problems. Should they refuse to be treated, drivers are often dismissed – or they quit before they can be fired. Many go on to work for companies who don’t have such policies or treatment programs.

Professional drivers put those they share the road with at risk by not treating their sleep apnea. Falling asleep for even a moment can have deadly consequences for not only for the driver, but for everyone in their immediate surroundings. Unlike smaller vehicles, tractor trailers can’t stop quickly.Even if a drowsy driver has great reaction speeds, a truck of that size simply can’t slow down in time.

A driver is recovering in the hospital after a scary accident in Roanoke County. The crash occurred on I-81 when a Jeep Grand Cherokee crashed through a median and guardrail. The car struck a tractor trailer, a straight truck and two other cars traveling in the southbound lanes. Miraculously, no one was killed. Only one person was injured in the accident.

Police charged the driver of the Jeep Grand Cherokee with reckless driving. It’s not immediately clear why the driver lost control of his vehicle. Many times, reckless drivers lose control like this because they are drowsy, drunk or drugged behind the wheel. Though the accident did not occur late at night or early in the morning, it is still possible that the driver nodded off behind the wheel.

Another potential cause? Distracted driving. With smartphones in every hand, it’s more difficult than ever for drivers to stay focused on the road. Most people are guilty of taking their eyes off the road for a moment to pick up a phone call or open a GPS application on their phone. Those moments are all it takes to cause a massive accident like this one.

Given the kinds of vehicles involved in this wreck, it’s especially lucky that the accident didn’t result in more serious injuries. When cars and big rigs collide, it usually spells serious trouble. Tractor trailers struggle to brake as quickly as smaller cars, so accidents on the highway involving large trucks can often be devastating. Always leave plenty of distance between you and a tractor trailer just in case a freak accident like this occurs. No one can predict when a driver might lose control, so driving defensively is your best bet to stay safe.

Want to be sure you’re leaving plenty of room between you and a truck ahead? Try out the three second rule. Pick a landmark like a sign or billboard and begin counting when the vehicle in front of you passes it. If you reach the landmark in three seconds or less, chances are good you need to increase your following distance.
